1. Acceptance of Terms

Purchasing and using MINIVPS services constitutes a binding contractual agreement between the customer and MINIVPS.

By registering, selecting the option “I have read and accept the Terms of Service” and making payment, the customer declares that they have read, understood and fully agreed to this document, the Privacy Policy and the Service Level Agreement (SLA).

Electronic acceptance is fully legally valid under the Brazilian Civil Code, the Brazilian Internet Civil Framework (Law No. 12,965/2014) and Law No. 14,063/2020.

2. Term and Renewal

The contract takes effect on the date the service activation email is sent and remains in force for the contracted period (monthly, quarterly, semiannual or annual).

At the end of the contracted period, the service may be renewed automatically for the same term, unless the customer requests cancellation at least 1 (one) day in advance.

3. Payment and Billing

Services are provided on a prepaid basis, with payment in advance via Pix or bank slip (PagHiper), credit card (Stripe) or PayPal.

Automatic renewal is available only to customers with a valid credit card linked to their account.

Invoices are issued at least 7 (seven) days in advance. Non-payment may result in automatic suspension of the service 1 (one) day after the due date and permanent cancellation 2 (two) days after the due date.

4. Cancellation and Refunds

MINIVPS may suspend or cancel the services at any time, upon notice, in cases of violation of these Terms or applicable law.

When cancellation is initiated by MINIVPS without any breach of contract by the customer, a refund proportional to the unused period may be granted, where applicable.

Prepaid services, including domains and third-party licenses such as cPanel, are non-refundable.

5. Credits and Right of Withdrawal

Credits are prepaid and cannot be converted into cash.
The customer may exercise the right of withdrawal within 7 (seven) calendar days, provided the credits have not been used.
In case of partial use, the refund will be proportional to the remaining balance.
After the legal period, credits become non-refundable, except in the event of a proven failure in the provision of the service.
Refunds, when due, will be processed through the same payment method within 7 (seven) business days.

6. Prohibited Use and Illegal Content

Using the services for illegal or unauthorized purposes is expressly prohibited, including but not limited to:

Copyright infringement;
Distribution of illegal content;
Botnets, malware or malicious activities;
Phishing, spam or unsolicited email;
Use of unauthorized torrents or trackers.

The customer is fully responsible for the content stored and for the security of the contracted environment.

7. Technical Support

Technical support is provided exclusively via the email suporte@minivps.com.br and is limited to matters related to the infrastructure and the management panel.

8. Limitation of Liability

MINIVPS does not guarantee that the services will be uninterrupted or error-free. Under no circumstances will the company’s total liability exceed the amount actually paid by the customer in the last 30 (thirty) days.

MINIVPS is not responsible for data loss, lost profits or indirect damages, unless otherwise provided by law.

9. Personal Data Protection

Personal data is processed in accordance with the Brazilian General Data Protection Law (Law No. 13,709/2018), as described in the MINIVPS Privacy Policy.

10. Jurisdiction and Governing Law

This contract is governed by the laws of the Federative Republic of Brazil. The courts of Itajaí/SC are elected as the venue, waiving any other, unless otherwise provided by law.

11. Declaration of Acceptance

By electronically accepting these Terms, the customer declares that they are aware of and agree with all the conditions set out herein, acknowledging their legal validity.
